TERMS & CONDITIONS

Customer/ Client / Participant: Our terms & conditions carefully apply to all commercial relationships between the company Dawn Patrol Bali and the customer (you), and are recognized as standard for the industry. Dawn Patrol Bali values surfing as much more than just a sport- it is a lifestyle that embraces a relaxed, easy going environment. It is nevertheless necessary to kindly remind customers that when two parties enter into a business relationship, there must be set terms & conditions agreed upon and respected to allow the relationship to run smoothly in a cooperative manner.

Customer/ Client / Participant:

When you reserve and/or book a Surf Experience* with us, you are agreeing to these bilateral rights described in our Terms & conditions below.

*Surf Experience includes:

Surf Lessons, Surf Guiding, Surf Trips or Tours and any other service/3rd party service, for example photography provided under Dawn Patrol Bali.

1. Closing Bookings
All reservation requests must be made in written form via email, WhatsApp Messenger, Facebook Messenger or Instagram. This enables us to track and examine the booking process in case a misunderstanding or miscommunication arises. Once the booking confirmation with agreed priced is received from the customer, the contract between Dawn Patrol Bali and said customer becomes binding. These general terms & conditions of Dawn Patrol Bali are implicitly accepted from when the customer sends the booking request. In some cases Dawn Patrol Bali will request payment before the scheduled surf experience. If requested to make a deposit payment or full payment: as soon as payment is received from the customer, the booking becomes binding. If the customer fails to make the required payment in the assigned timeframe, the booking is simply cancelled with written notice.

Bookings, reservations and requests are all subject to prices and conditions at the time of booking, as can be seen on Dawn Patrol Bali’s website www.dawnpatrolbali. com. Prices on other 3rd Party advertising platforms collaborating and representing Dawn Patrol Bali may differ from our website. In this scenario, we will amend the 3rd party’s advertised price to correspond with our current website prices. If a booking is for the following season, the prices and services defined on the customer invoice from Dawn Patrol Bali apply even if they happen to differ from the prices and services described on the website.

All optional details and extras requested by the guest regarding services, surfing lessons, surfboard rental, etc., must be explicitly specified at the time of booking and are considered binding.

All customers must be at least 18 years old to make a booking unless they have the expressed written consent of their parents.

4. Prices and Services
All prices and services are subject to change. Any updates or changes are to be confirmed in writing by Dawn Patrol Bali to affected customers. Dawn Patrol Bali reserves the right to change prices without prior notice in the event of changing conditions (currency fluctuations, new government-mandated price regulations, altered or new fees from third party providers, etc.). Dawn Patrol Bali also reserves the right to change services or offer, whether general or individually agreed upon, in extraordinary cases (e.g., force majeure, governmental regulations, delays of third parties, weather and oceanic conditions). Customers will be informed as soon as possible of any changes to any essential paragraph in their contract.

5. Insurance
We at Dawn Patrol Bali recommend that all customers purchase travel medical insurance before arriving in Bali that covers transportation back to the patient’s point of embarkation as well as on-site hospital treatment. These options are the full responsibility of the customer and it is important to note that some insurance companies or individual plans may not cover accidents that occur while surfing or practicing other sports. Dawn Patrol Bali can only be held responsible in the instance of accidents resulting from faulty or inappropriate equipment.

Dawn Patrol Bali does not cover health insurance for customers taking a surf experience. We kindly offer a full refund to customer for any losses due to cancelling a booking in the incidence of injury, illness or other medical impairment that prohibits the customer from traveling or participating in booked travel/surf activities. A refund can be claimed with proof in the form of a doctor’s note.

7. Disclaimer
Participation in and at any services, arrangements and activities under the auspices of Dawn Patrol Bali is entirely at the customer’s own risk. Customers release, waive and hold the company, its offices, agents and/ or employees unaccountable from all claims, losses, damages, commitments, expenses (including legal costs) during or in conjunction with their participation in activities conducted and organized by Dawn Patrol Bali, arising from, but are not limited to, any injury, accident, illness, death, material damage or personal damage to the customer or to others.

The customer guarantees Dawn Patrol Bali, its officers, agents and/or its employees against all claims, losses, damages or expenses that any one or more of his/her executors, administrators, heirs, next of kin, successors or assignees may have in conjunction with his/her participation in activities conducted and organized by Dawn Patrol Bali, and against any costs including, legal fees, that may incur as a result of any such claims, losses damages or expenses, whether valid or not.

10. Surf Board Rental
Customers of Dawn Patrol Bali renting a surf board (privately: outside of a surf lesson or instructor present with you in the water): Before renting a surf board we give the following notice: you are expected to check the condition of your surfboard and ensure the Staff are aware of any pre-existing damage before entering the water. We cannot offer any insurance cover when renting our surfboards and therefore kindly ask you to take care of our equipment and accept responsibility for any damage you in incur as follows:

  • Ding: IDR 50,000-300,000
  • Snapped Leg Rope: IDR 350,000
  • Snapped Surf Board: IDR 2,500,000
  • Lost Fin: IDR 150,000 (1 set)

We acknowledge that upon a customer renting a Dawn Patrol Bali surf board, that you have agreed to these terms and conditions.

12. Exclusion of Participation
Participants must implicitly follow Dawn Patrol Bali’s staff instructions. If a customer fails to disclose physical and/or other health issues, disabilities or other factors that may make him or her unfit for surf-related activity, acts irresponsibly and/or causes disturbances that result in endangerment of the provision of service and/or the health or the image of other participants or the company, its reputation and its employees, that customer- after being warned by Dawn Patrol Bali staff, can be excluded from the participation in any or all activities run by Dawn Patrol Bali. In such cases, Dawn Patrol Bali may terminate the contract without any further notice, with no refunds made. Any costs incurred by the actions of the customer are to be paid by the customer.

14. Risks
Surfing holidays, like many adventure and sporting activities, especially water-based ones, include a certain degree of risk. Before participating in surfing, individual potential customers must decide (with the help of a doctor if necessary), whether their current level of physical fitness and health is adequate to engage in such a strenuous physical activity. By entering into contract with Dawn Patrol Bali, the customer consents cover for all necessary costs for medical treatment in eventual cases of injury or illness due to accidents or chance and during a surfing lesson or surf guiding, or related activity associated with Dawn Patrol Bali. The customer also agrees to indemnify Dawn Patrol Bali in case such treatment is necessary.

15. Place of Jurisdiction & Applicable Law
The place of jurisdiction and applicable law is the legal residence of the company, Dawn Patrol Bali. Any legal claim against Dawn Patrol Bali shall be governed in all respects by and in accordance with the laws of Indonesia.

2. Payment Conditions
After the contract has been made firm and the return email with the invoice has been received (considered to be a booking confirmation) the customer must pay the invoice in accordance with the following stipulations:

  • Customers have 14 days after the invoice date to pay in full to the account stated on the invoice and without any deductions such as bank fees, etc.
  • In the instance of delays in payment, Dawn Patrol Bali has the full right to cancel the booking. In cases of cancelled bookings, Dawn Patrol Bali will inform the customer via email.

Payments made in Bali shall be paid on the day of your scheduled surf experience before for example your surf lesson in cash in local currency (IDR). Credit cards are also accepted with a surcharge of at least 3%.

3. Cancellation & Re-bookings

Cancellations and re-bookings made by the customer: All requests for cancellations or re-bookings request must be submitted via email. The cancellation period is defined by the receipt of the cancellation. In cases of cancellation, the below fees may apply, depending on the cancellation date.

Surf Trip/Tour cancellations:

  • 30 days in advance: Deposit
  • 10 days in advance: 80%

Surf Lesson / Surf Guiding cancellations:

  • 20 days in advance: Deposit
  • 5 days in advance: 80%

If a guest does not cancel and does not turn up, they will receive no refund.

Any surf session included in a package can only be availed of by the package holder and if unused, is strictly non-refundable.

Prior to re-booking, the following conditions apply:

If a customer would like to rebook their surf experience where it does not affect other customers, for example our surf trips need a minimum of 3 people to go ahead, no charges will be incurred and we will reschedule your experience. If your booking affects other customers, the above-mentioned cancellation conditions apply.

Cancellation by Dawn Patrol Bali:

Dawn Patrol Bali reserves the right to opt out of a contract under the following extraordinary circumstances: In the case that certain conditions prevent the booked service and/or arrangement from being carried out or in cases of unacceptable danger, Dawn Patrol Bali reserves the right to cancel the contract with immediate effect. Any payments that have been made by the customer are to be fully refunded. Dawn Patrol Bali will not refund any additional expenses incurred above and beyond the original invoiced amount.

6. Statement of Health & Physical Fitness
By booking, clients confirm they are physically fit and without injuries or physical conditions that may affect or be affected by surfing and activities relating to surfing. Requirements include a good level of physical fitness and competent swimming skills. This is in order to maintain a high standard of safety for yourself and our surf instructors. It also ensures a sufficient standard of class in the case of semi-private or group surf lessons, whereby avoiding other group members becoming dissatisfied due to the physical limitations of one student bringing down the level of instruction. If there is any doubt, potential customers should consult a doctor before booking a surf experience.

8. Surfing
Dawn Patrol Bali follows strict standards of safety. Employees regularly attend safety, first aid and surf lifesaving courses according to Australian or European Standards. All surf lessons are given by Australian/ European-certified instructors. We provide trained surf instructors who carefully choose surf spots that match the surf level of participants, thereby maintaining a low accident and injury risk. That said, Dawn Patrol Bali is not liable for any accidents or injuries that occur during surfing and surfing-related activities. However, in the event of injury, customers are responsible for their own medical costs. Please refer to your medical travel insurance in order to familiarise yourself with any healthrelated issue that may arise on your trip.

9. Poor Surf Conditions
Dawn Patrol Bali is not responsible for poor surfing conditions- even if surfing is deemed to be not possible after driving to a surf spot on a given day. However, Dawn Patrol Bali will make every endeavor to make sure that surf instruction will take place at the proper spot at the next opportune time, spending as much time on as many good waves as possible. Nevertheless, there may be days where poor weather, dangerous conditions or low-quality waves make it difficult or impossible to surf. Unfortunately, we can neither control nor predict these factors. We will do our best to reschedule your lesson or guiding session. If in the case of a surf trip: Even when conditions are so poor/dangerous/or low quality as to make it impossible to surf, these events will be counted as ‘sessions’ within your surf trip and non-refundable.

11. Transport
Transport* to surf spots are included in the fees for all surf sessions; surf guiding or surfing lessons. The spots are chosen by the surf instructors who, according to their expertise familiarity with local conditions, select the locations best suited to the level of guests with least risk of safety hazards.

* We offer a transport pick-up and drop off service that is free for customers located within the Bukit area – 35 minute perimeter of Balangan Beach. Anywhere outside of this area, we kindly ask for an additional driver’s fee as follows based on a round trip:

Kuta Area: IDR 150,000
Sanur Area: IDR 200,000
Canggu /Seminyak Area: IDR 200,000
Ubud: Please arrange with your homestay in Ubud

13. Data Usage & Protection
In the course of our surfing activities we may film or photograph you for use on our website or in promotional videos, etc. As the customer, you therefore agree that you may be photographed and/or filmed during your the course of activities and in connection with Dawn Patrol Bali. You also consent to Dawn Patrol Bali’s use of such photographs or recordings for promotional and/ or advertising purposes and without additional prior consent. The customer furthermore agrees to allow his or her personal data to be used by Dawn Patrol Bali for the purposes of marketing and market research. Dawn Patrol Bali offers the assurance that all personal data is to be treated with confidence and will not be willingly transferred to any third parties except with the purpose of fulfilling your booking(s) and providing relevant service. At any point, the customer may terminate this agreement via email. In such a case, your personal data, images and/or footage will not be used for any of the above reasons.
